You agree that transactions made through MEPL Website shall be through your own bank account only and the said transactions do not contravene any Act, Rules, Regulations, Notifications of Income tax Act, Anti money laundering laws, Anti-corruption laws or any other applicable laws.

The User hereby confirms through the usage of the Website or Services of MEPL:

MEPL will not be held responsible for information of persons below the age of 18 and User is urged to contact MEPL representative assigned to User for providing such information.

That User has read and understood the Privacy Policy published on the Website and unconditionally confirm that the information provided by User upon registration or when prompted on the Website is true and correct. That You shall notify and update MEPL promptly of any material change in your personal information and/or profile so as to enable MEPL to rely on the most recent information provided.

That You agree to be contacted by MEPL and its employees and partners over phone and/or E-mail and/or SMS or any other form of electronic communication in connection with your registration, advisory and transactions.

Scope of Services

BharatAdvisor service is limited to providing the User’s own Goal planning tool. The Services be limited to devising a BharatAdvisor software generated Plan, on basis of clients future financial goals, current financial earnings as well as already existing financial commitments. The whole system of suggesting planning is software auto generated. The accuracy of data provided is of paramount importance for correct plan projections. The service is on a non-exclusive basis for an agreed fee structure and for a period hereinafter described, entirely at the User’s risk.

The Goal plan provided will be limited to broad financial projections without any specific advise about any particular product. The particular product can be decided by client from market basis his own research or advice he can get from providers registered with SEBI. For example: Plan via software generated will be limited to suggesting an SIP planning, but will not suggest which SIP plan or shares to buy. Any portfolio structure will not be provided.

The Goal plan generated through BharatAdvisor is based on assumptions and user has full discretion to change these assumptions and output plan will be generated accordingly.

The BharatAdvisor/ MEPL will have no authority or responsibility over the user’s execution of plan suggested by BharatAdvisor tool. The actual execution shall be undertaken by the Client with his own chosen assumptions. And That information after investment should be updated to keep goals chart on track

The user shall provide the BharatAdvisor software with clear financial objectives including, but not limited to, period and purpose of planning, income details, existing investments, risk appetite etc., and other pertinent matters as may be reasonably required by the BharatAdvisor software from time to time.

The User has the sole discretion to decide on whether to act upon the plan tendered by the BharatAdvisor’s software program and the MEPL shall have no power, authority, responsibility or obligation to ensure or cause the client to act upon the plan suggested by BharatAdvisor pursuant to this agreement.

The User hereby agrees and acknowledges that all the decisions of the User, notwithstanding the Services rendered by BharatAdvisor/ MEPL, in relation to start any plan shall be based on User’s own independent evaluation of the risks and rewards and User’s own verification of all the relevant facts, including financial and other circumstances and a proper evaluation thereof.

User agrees that the Services are in the nature of financial basic guidance enabling the User to make informed decisions and neither MEPL or its brand BharatAdvisor nor any of our employees or agents shall be liable for any plan generated by software on website/app hereunder and it will be the User’s responsibility to make an independent assessment pursuant to the availing/using of the Website/ Services or availing any product or services from the third-party provider.

The User expressly acknowledges and agrees that all investments are subject to third party risks, market risks etc., and in no circumstance shall the MEPL or BharatAdvisor be liable for any losses suffered by the User as a result of any investment made pursuant to plan generated through tool. Stating again that BharatAdvisor only provide a user’s his own goal planning tool which provides a broad goals plan with zero investment advice. Further, User acknowledges and agrees that no warranties or commitments are being made by MEPL or BharatAdvisor or any of its employees, agents or representatives that availing of the Services from the Website will result in meeting the objectives of the User or that availing/using of the Services/Website will not at any time be affected by adverse tax consequences, technical failures, timely regulatory compliance to a new law. All necessary regulatory changes and financial health changes of user need to be updated on website which may result in change in projections by BharatAdvisor software. BharatAdvisor/ MEPL will not be liable to the User or any person claiming for or on their behalf for any error of judgement or loss suffered by the User in connection with the Services provided to the User.

Limitation of Liability

The Parties hereby agree that the risks and losses incurred by the User in pursuance of Goal planning rendered by the BharatAdvisor program shall be borne solely and exclusively by the User and/or his legal representative.

Privacy

User agree to provide MEPL with proprietary, confidential or similar information and other data as mentioned under these Terms herein during your use and access of the Website or the availing of the Services. MEPL and its aforesaid constituents respect the privacy and confidentiality of such data and the provisions pertaining to such private information and data as provided shall be governed under the Website’ Privacy Policy under the link marked “Privacy Policy” on the Website of BharatAdvisor. By using and visiting the Website and availing the Services, you also agree to be governed by said Privacy Policy

Consideration

MEPL/BharatAdvisor may at its sole option choose and the User hereby unconditionally accepts that website may charge its Users a fee for use of Website, which charges may be updated from time to time. The user is expected and requested to read whole terms of services including scope before making the payment for fees/ charges.

Cancellation and Refund Policy

Any subscription or one time charges will be non refundable once paid.

In case of periodic subscription, User will have right to cancel the subscription before the renewal.

Confidentiality

The MEPL and BharatAdvisor agrees to handle all information provided by the User with utmost care and confidentiality in accordance with applicable regulations and prescribed industry standards. However, if required by an appropriate government authority or by the Regulations, the MEPL may have to divulge said confidential information but agrees to provide appropriate notice to the User before doing so.

Declaration

The MEPL shall have the full liberty and absolute discretion to make necessary changes in these Terms of Services and/or do any act, deed, matter or thing necessary to comply with any law for the time being in force and the MEPL or BharatAdvisor shall not be held liable for the same.

Arbitration and Dispute Resolution

Any dispute in connection with the interpretation, performance, termination of this Agreement, or otherwise in connection with this Agreement (“Dispute”) shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, as may be amended from time to time, or any re-enactment thereof, by a sole arbitrator to be mutually appointed by both Parties.

The arbitration proceedings shall be conducted at Delhi, in the English language.

The arbitration award in respect of a Dispute shall be final and binding on the Parties, and enforceable in accordance with its terms. The arbitrator shall state reasons for his / her findings in writing. The Parties agree to be bound thereby and to act accordingly.

Governing law and Jurisdiction

The dispute regarding Terms & Conditions shall be governed by the Laws of India. The Parties agree that the courts in Gurgaon shall have exclusive jurisdiction over any dispute arising out of this Agreement.

However, there are circumstances in which BharatAdvisor program cannot take action without certain of your personal data either to provide the Services or details if sought for by regulatory agencies.

Payment and billing information: We might collect your billing name, billing address and payment method when you buy our plan. We NEVER collect your credit card number or credit card expiry date or other details pertaining to your credit card on our website. Credit card information will be obtained and processed by our online payment partner Worldline. The data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) when processing payment.

Use of your personal information and Data

BharatAdvisor/MEPL uses data to:

process User’s application to avail Services and for MEPL/BharatAdvisor to provide requested Services;

comply with MEPL’s obligations arising from any contracts entered into between User and BharatAdvisor/MEPL and to provide User with the information, products and services that User requests from us;

help protect User information and prevent unauthorised access to it;

deal with any queries, complaints or problems reported by User;
